Ground Booking Terms and Conditions

St. Paul's Orthodox Church, McKinney (hereafter referred to as "Management") sets forth the following terms and conditions for Ground bookings:

1. Booking and Payment

1.1. All bookings must be made in advance through the official booking system.

1.2. Full payment is required at the time of booking to secure the reservation.

1.3. Cancellations made less than 24 hours before the scheduled time are non-refundable.

2. Use of Facilities

2.1. The Ground may only be used for its intended purpose as specified at the time of booking.

2.2. Users must adhere to the Ground's opening and closing times.

2.3. No unauthorized modifications or alterations to the Ground or equipment are permitted.

3. Responsibilities of the Booking Party

3.1. The person making the booking (hereafter "the Organizer") is responsible for:

a) Ensuring all participants are aware of these terms and conditions.

b) Maintaining order and appropriate behavior of all participants.

c) Reporting any damage or issues to Management immediately.

d) Ensuring proper disposal of trash in designated bins only.

e) Strictly enforcing the prohibition of alcohol and any other prohibited substances on the church property.

3.2. The Organizer must ensure that the Ground and facilities are left in the same condition as they were found.

3.3. Any damage caused during the booking period will be the financial responsibility of the Organizer.

3.4. All trash must be placed in bins provided. Failure to properly dispose of trash may result in additional cleaning fees charged to the Organizer.

3.5. The Organizer acknowledges that the consumption or possession of alcohol or any other prohibited substances on the church property is strictly forbidden. Any violation of this rule will be considered a serious breach of these terms and conditions.

3.6. The Organizer will be held responsible for any consequences arising from the consumption or possession of alcohol or prohibited substances during their booking period. This may include immediate termination of the event, forfeit of any fees paid, and potential legal action.

4. Responsibilities of Individual Participants

4.1. All participants must:

a) Follow the instructions of ground staff and the Organizer.

b) Use equipment properly and safely.

c) Respect other users and neighboring properties.

d) Dispose of any trash in the designated bins.

e) Refrain from bringing, consuming, or being under the influence of alcohol or any prohibited substances on the church property.

4.2. Participants are responsible for their personal belongings. Management is not liable for any loss or damage to personal property.

4.3. Any participant found in possession of or under the influence of alcohol or prohibited substances will be immediately removed from the premises. Such incidents may result in the immediate termination of the entire event at the discretion of Management.

4.4. Participants acknowledge that any consequences resulting from the consumption or possession of alcohol or prohibited substances are serious and may involve legal action.

5. Waiver of Liability

5.1. By booking and using the Ground, the Organizer and all participants acknowledge that:

a) Activities on the Ground involve inherent risks of injury.

b) They voluntarily assume all risks associated with the use of the facilities.

5.2. The Organizer and participants hereby waive, release, and discharge Management from any and all liability for:

a) Personal injury

b) Death

c) Property damage or loss arising out of or in connection with the use of the Ground and facilities.

5.3. Management is not responsible for any damage caused to vehicles or property on the nearby road due to any equipment or items leaving the Ground premises.

6. Nearby Road and Vehicle Damage

6.1. Users of the Ground acknowledge that there is a road passing nearby the facility.

6.2. The Organizer and all participants understand and agree that if any equipment or items leave the Ground premises and cause damage to any vehicle or property on the nearby road:

a) Management is not responsible or liable for any such damage.

b) Any costs, claims, or legal actions arising from such incidents will be the sole responsibility of the Organizer and/or the individual participant who caused the item to leave the premises.

6.3. The Organizer is advised to take necessary precautions to prevent items from leaving the Ground and to inform all participants of this risk and liability.

7. Parking

7.1. The Organizer and all participants must ensure that their parking does not cause any disturbance to the roads or to Management.

7.2. Vehicles must be parked only in designated areas.

7.3. Management reserves the right to have improperly parked vehicles removed at the owner's expense.

7.4. The Organizer is responsible for informing all participants about proper parking procedures.

7.5. Any fines or penalties incurred due to improper parking will be the sole responsibility of the vehicle owner.

8. Cancellation by Management

8.1. Management reserves the right to cancel or reschedule any booking under any circumstances.

8.2. In the event of a cancellation by Management:

a) The Organizer will be notified as soon as possible.

b) Any fees paid for the cancelled booking will be fully refunded.

c) Management will not be liable for any additional costs, losses, or inconveniences incurred by the Organizer or participants due to the cancellation.

8.3. The Organizer acknowledges and accepts this cancellation policy as a condition of making a booking.

9. Insurance

9.1. The Organizer is strongly advised to obtain appropriate insurance coverage for the event and participants, including coverage for potential damage to vehicles or property outside the Ground.

9.2. Management's insurance does not extend to cover the Organizer, participants, or any damage caused outside the Ground premises.

10. Right of Refusal

10.1. Management reserves the right to refuse entry or terminate the booking of any individual or group failing to comply with these terms and conditions.

11. Amendments

11.1. These terms and conditions may be amended by Management at any time without prior notice.

11.2. The current version will always be available for review at the time of booking.
